Vogel Creek Monthly Update

June 2005 Update
Phase II Excavation Project Long Creek Drive to Arncliffe Drive
CenterPoint Electric, CenterPoint Gas, TimeWarner Cable and SBC each independently reported to HCFCD that the utility work necessary for Phase II had been completed. Upon initiation of construction by our Contractor on June 20th, a live fiber optic cable belonging to TimeWarner was found within the excavation limits of the project. HCFCD notified TimeWarner of the cable, and based on information provided by TimeWarner, HCFCD anticipates the cable will be relocated out of the project limits by Wednesday morning, July 6th.
Although site preparation by HCFCDs Contractor has been ongoing since June 20th, the construction efforts have been delayed because of the necessary utility work by TimeWarner. The anticipated start date for Hard Rock Construction, Inc. to begin is now July 6th. This is a 30-working day contract.
Utility Adjustment Work
Utility work on the Phase II Excavation Project has been completed except as noted above.
For the Ultimate Channel Conveyance Improvement Project, HCFCD has received utility adjustment proposals from CenterPoint Gas and from TimeWarner Cable. Proposals from CenterPoint Electric and SBC have not yet been received but have been promised within the next week. When the proposals are acceptable to the District, contracts will be prepared and submitted to Commissioners Court for approval. After the contracts are approved, purchase orders are issued and the utility companies are then authorized to proceed with the adjustments.
Right-of-Way
The Harris County Right of Way Division is in the process of acquiring 16 tracts in which partial property is needed for the Vogel Creek project, including 8 tracts located within the Inwood Forest Golf Course.
Offers have been made to all owners. To date, 5 of the 16 tracts have been purchased by HCFCD.
In a letter sent out the week of June 20th, HCFCD notified 22 property owners that their fences, which appear to be located on HCFCD right-of-way, will be in the way when we begin the ultimate channel construction. Those residents were alerted that the encroaching fence is an obstruction to the construction and future maintenance of Vogel Creek and must be removed by the resident before September 30, 2005. While it is HCFCDs preference that the residents remove the encroachment(s), any encroachments that remain when the contractor gets there will be removed and neatly stacked on the residents property. In the event HCFCDs contractor removes the encroachments, the HCFCD will not be legally liable for any damage that may occur to the property.
