Vogel Creek Monthly Update


August 2005 Update (issued on September 2, 2005)

Phase II Excavation Project Long Creek Lane to South of Arncliffe Drive
Following the relocation of the live TimeWarner fiber optic cable and other unexpected weather delays, construction crews from Hard Rock Construction, Inc. began excavating on the Phase II project on July 26, 2005. Construction work is approximately 70% complete at this time.


Ultimate Conveyance Improvement Project

Design
As mentioned at our last HOA/Civic Club Presidents meeting, CivilTech Engineering, Inc. (CEI) has completed the 80% design of the ultimate Vogel Creek conveyance improvement project and that design is being routed within HCFCD and the City of Houston for review and approval. HCFCD completed its review on Aug. 9, 2005, and CEI is currently incorporating the review comments into the plan. Review comments from the City of Houston have not yet been received.

Utility Adjustment Work
Utility adjustment proposals for the ultimate channel conveyance improvement project have been received from all utility companies. Contracts were prepared and approved by Commissioners Court on Aug. 9, 2005 (CenterPoint Electric), and Aug. 23, 2005 (CenterPoint Gas and SBC). Subsequently, purchase orders will be issued by HCFCD, and the utility companies will then be authorized to proceed with the adjustment work.

Right-of-Way
The Harris County Right of Way Department is continuing the process of acquiring 16 partial property tracts, including 8 tracts located within the Inwood Forest Golf Course, needed for the Vogel Creek project.

Offers have been made to all 16 owners. To date, 6 of the 16 tracts have been purchased by HCFCD.

We are still negotiating with the Inwood Forest Golf Course for property necessary for the completion of the Vogel Creek project. If an agreement cannot be reached, HCFCD will proceed with condemnation. We remain hopeful that the Inwood Forest Golf Course and HCFCD can come to a fair and mutually beneficial resolution. We will continue to keep you posted.
